The following Terms of Service Agreement (“Agreement”) apply to the MBA Math web site www.mbamath.com (“Web Site”) created by DecisionClass, LLC and to the software, services, and materials on the Web Site (“Site Content”). By registering as a user (“User”) of the Web Site, you accept and agree to comply with the following Terms of Service.
DecisionClass, LLC reserves the right to change the Agreement. Changes will be posted to this page. Please review this link regularly to see any changes. Your continued use of the Web Site signifies your acceptance of any changed items.
Account Non-Transferability
Your MBA Math user name and password entitle User to a personal, non-exclusive, non-assignable, and non-transferable license to use the Web Site and the resources linked to it according to these Terms of Service. You are not authorized to sublicense, transfer, sell, or assign the license.
Use of Material
The Web Site is for your personal use. You agree not to reproduce, modify, retransmit, resell, create derivative works from, or transfer, for any commercial purposes, any portion of, or access to, the Web Site or Site Content.
Copyright and other laws in the United States and elsewhere protect the material on the Web Site. Unless otherwise indicated, all material on the web site is Copyright © 2005-2023 DecisionClass, LLC. Other trademarks and service marks mentioned on this website are the property of their respective owners.
Termination
DecisionClass, LLC reserves the right to terminate your use of the Web Site if DecisionClass, LLC believes that you have violated or acted inconsistently with the letter or spirit of the Agreement. You will be notified by e-mail of such termination. Upon such termination, you or the party that paid for your account will be refunded a prorated amount for the remaining duration of your account term. Such a refund may depend on your providing a mailing address to which payment in U.S. dollars by U.S. bank check can be sent.
Privacy Policy
Any personal information you provide to DecisionClass, LLC is subject to our Privacy Policy. For more information, click the Privacy Statement link on the site's home page.
No Warranties/Limited Liability
THE WEB SITE AND ALL ITS CONTENTS ARE PROVIDED ON AN “AS IS” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED.
YOUR USE OF THE WEB SITE IS AT YOUR OWN RISK. IF YOU ARE DISSATISFIED WITH ANY OF THE MATERIALS OR OTHER CONTENTS OF THE WEB SITE OR WITH THIS AGREEMENT, THE PRIVACY POLICY, OR OTHER POLICIES, YOUR SOLE REMEDY IS TO DISCONTINUE USE OF THE WEB SITE.
DECISIONCLASS, LLC WILL NOT BE LIABLE TO USER FOR ANY DAMAGES BEYOND THE AMOUNT OF MONEY THAT USER HAS ACTUALLY PAID TO DECISIONCLASS, LLC DURING THE PREVIOUS TWELVE (12) MONTHS (OR IF THE CURRENT ACCOUNT HAS BEEN ACTIVE FOR LESS THAN TWELVE (12) MONTHS, DURING THE TIME SINCE USER’S ACCOUNT TERM BEGAN).
Entire Agreement
The Agreement constitutes the entire agreement between User and DecisionClass, LLC. The Agreement governs User’s use of the Web Site, superceding any prior agreements between User and DecisionClass, LLC.
Jurisdiction
The courts in Bristol County, Rhode Island, will have exclusive jurisdiction in all disputes relating to the use of the Web Site.
Choice of Law
The Agreement, User’s rights and obligations, and all actions contemplated will be governed and construed in accordance with the laws of the United States of America and Rhode Island State, as if the Agreement was a contract wholly entered into and performed within Rhode Island State.
